Early Access Agreement

This Early Access Participation Agreement ("Agreement") is between Buddywise AB, org. no. 559254-9777 ("Buddywise") and you, the user. By opting into the Buddywise Early Access Program ("the Early Access"), you agree to these terms, which supplement and supersede any conflicting terms in the standard Buddywise Agreements regarding your use of experimental features.

1. The Early Access Program

The Early Access Program provides early access to experimental AI-powered features. You acknowledge that the Early Access features are in active development and may not perform at the same level as Buddywise’s commercially released, standard services. Buddywise reserves the right to modify, suspend, or terminate the Early Access Program, or your access to it, at any time and for any reason without notice.

2. Privacy and Data Collection

When participating in the Early Access Program, Buddywise will collect specific usage data, user inputs, AI outputs, and telemetry to evaluate and improve the software. The collection, use, and retention of this data are governed exclusively by the Buddywise Early Access Privacy Notice.

3. Intellectual Property and Feedback

We welcome your feedback, ideas, bug reports, and suggestions regarding the Early Access Program ("Feedback"). By submitting Feedback, you grant Buddywise a perpetual, irrevocable, royalty-free, worldwide license to use, modify, distribute, and incorporate such Feedback into our products and services without any obligation or compensation to you.

4. Disclaimer of Warranties ("As-Is")

The Early Access features are provided exclusively on an "as is" and "as available" basis. to the maximum extent permitted by applicable law, Buddywise expressly disclaims all warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Buddywise does not guarantee that the Early Access features will be uninterrupted, secure, or error-free, or that AI-generated outputs will be accurate or reliable.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Buddywise be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your participation in the Early Access Program, even if Buddywise has been advised of the possibility of such damages. Your sole and exclusive remedy for any dissatisfaction with the Early Access Program is to stop using the Early Access features.

6. Governing Law and Dispute Resolution

This Agreement shall be governed by the Swedish laws, excluding its choice of law principles. Any disputes arising from the interpretation and application of this Agreement shall be settled in the general court where you reside.

Data Isolation

This is your organisation's data only, and each customer's data is kept separate from every other — exactly as in the rest of Buddywise. Nothing here is shared between customers. Phoenix is an open-source LLM-diagnostics tool (by Arize AI) that we self-host on our own infrastructure — it is not a third-party service that receives your data.
